These Terms and Conditions ("Terms") govern your access to and use of the Mephtah mobile application ("App"), operated by PHUM KREUS ANGKOR & PKA COFFEE RESTAURANT ("we", "us", or "our"), located at St 498, Sangkat Phsar Doeum Thkov, Phnom Penh, Cambodia. By downloading, installing, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Use of the App

The App allows registered users to browse and place orders for goods, items, or services (such as food, beverages, or related products) offered by us on a one-time payment basis ("Orders"). The App is provided for your personal, non-commercial use.

2. Eligibility and Accounts

To use certain features, you must create an account. You represent that you are at least 18 years old (or the age of majority in your jurisdiction) and capable of entering into binding contracts. When creating an account, you agree to:

• Provide accurate, current, and complete information.
• Maintain the security of your account credentials and not share them.
• Notify us immediately of any unauthorized access or use.

We reserve the right to suspend or terminate accounts for violations of these Terms.

3. Orders and Payments

• All Orders are subject to availability and our acceptance.
• Prices are displayed in the App and include applicable taxes unless stated otherwise.
• Payment is processed on a one-time basis via available methods in the App. You authorize us (or our payment processors) to charge the selected payment method.
• We do not store full payment card details; payments are handled securely by third-party providers.
• Once an Order is placed and confirmed, it is binding. We may cancel Orders due to errors, unavailability, or other reasons, with notification and potential refund.
• Refunds, if any, are at our discretion and subject to our policies.

4. No User-Generated Content

The App does not allow users to upload, post, or create content (such as text, images, or reviews). Any interaction is limited to ordering and related communications.

5. Promotions, Contests, and Sweepstakes

We may from time to time offer promotions, contests, or sweepstakes through the App. Participation is subject to separate rules provided at the time of the offer, which are incorporated into these Terms. We reserve the right to modify, suspend, or cancel any promotion at any time.

6. Feedback and Suggestions

If you provide feedback, suggestions, or ideas about the App or our services, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use, implement, and incorporate them without any compensation or credit to you.

7. Intellectual Property

The App, including its design, text, graphics, logos, software, and other content (excluding any third-party elements), is owned by us or our licensors and protected by copyright, trademark, and other laws. You may not copy, modify, distribute, sell, or create derivative works from any part of the App without our prior written consent.

8. User Conduct

You agree not to:

• Use the App for any illegal, fraudulent, or unauthorized purpose.
• Interfere with the App's operation or security.
• Attempt to gain unauthorized access to accounts or systems.
• Misuse promotions or engage in abusive behavior toward our staff or services.

Violations may result in termination of your access.

9. Account Termination and Deletion

9.1 Our Right to Suspend or Terminate

We may suspend or terminate your account and access to the App at any time, without prior notice, if we believe you have violated these Terms, applicable laws, or for any other reason at our sole discretion. Upon termination, your right to use the App ends immediately.

9.2 Your Right to Delete Your Account

You may delete your account at any time if you no longer wish to use the App. To request account deletion:

• Contact us directly using the methods below in Section 13 (e.g., by emailing info@mephtah.com with your registered email or phone number and a clear request to delete your account).
• We will process your request within a reasonable timeframe (typically within 30 days, subject to any legal obligations to retain certain data, such as for tax, payment records, or order history purposes).
• Upon successful deletion, your personal account data will be removed or anonymized where possible, and you will no longer be able to access or use your account. Any pending Orders or unresolved issues may need to be addressed before deletion can be completed.

Note: Deleting your account is permanent and irreversible. We may retain limited data as required by law (e.g., transaction records for accounting or dispute purposes), but it will no longer be linked to an active user account.

10. Disclaimers and Limitation of Liability

The App and services are provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, Orders, or inability to use the App, even if advised of the possibility of such damages. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Kingdom of Cambodia, without regard to conflict of law principles. Any disputes arising from these Terms or the App shall be resolved exclusively in the courts of Phnom Penh, Cambodia.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes (e.g., via the App or email). Continued use after changes constitutes acceptance.
